HISTORY OF MSP SINCE 2013

Journey of voice of Ex Servicemen Society to fight for equal rate of MSP to all combatant ranks:
1. 01.12.2013- a representation was submitted to Prime Minister of India to grant equal rate of MSP to all ranks.
2. 21.3.2014- Army HQ replied that our proposals have been received from PMO and same are being deliberated for possible inclusion in our draft proposals submitted to Central Pay Commission vide their letter No C/7087/APCC dated 21.3.2014.
3. 2014- Two small agitation staged at jantar mantar in support of our demands
4. 02 Aug 2015 – A huge agitation and ‘Sansad Gherao’ organized at Jantar-Mantar in support of our demands and ESMs from all over the country participated in agitation and MSP was one of core issue.
5. Sep 2015- Another huge rally was organized followed by hunger strike at jantar –matnar. New Delhi.
6. Sep 2015- Meeting with Jt Secretary of Prime Minister Office was held and it was assured that this demand may be accepted during 7th CPC.
7. 01.01.2016- Since, 7th CPC did not recommended equal rate of MSP, a representation against anomalies of 7th CPC report submitted.
8. 2016- Post War Committee report, Kamat Committee report, 3th pay commission report and other information in support of our claim for equal rate of MSP were obtained from the relevant authority.
9. 2016- Office bearers and members of the organization did ‘pad yatra’ from Bagha Border to New Delhi by bearing T Shirt and slogan of “Equal MSP and end Discrimination” written on the T Shirt and organised meeting of ESMs at Ludhiyana and other part of Punjab, Haryana , Himachal, Uttrakhand, Bihar, UP, J&K, Rajsthan etc to aware them.
10. 2017- We filed PIL in the matter but Honorable Delhi High court ruled that PIL in service matter will not be entertained. Accordingly we should file writ.
11. 02-08-2017 – Our writ petition No 6607/2017 for grant to equal rate of MSP was listed in Delhi high Court as the Govt has not accepted our demand for equal rate of MSP. The same was again listed on 17.10.2018.
12. 28.11.2017 -High Court issued order to the Govt to decide our representation dated 01.01.2016 within 8 weeks by passing a speaking order. Same day a petition for two individuals was also listed and hence court ordered was applicable to them also.
13. 10.4.2018 – Since, the Govt has not issued speaking order we again gone to the court.
14. 17.5.2018 – Despite court order, the Govt did not issue speaking order in our case.
15. 23.10.2018- Case was also listed on date and Govt counsel urged that on 29.12,2017, the Govt has rejected the representations of two individuals and handed over the office memorandum to our advocate issued to individual petitioner and the honorable judge said that we should file afresh case challenging the office order issued in case of two individual.
16. The Govt has been away from passing the order in our case and exercise all means to delay it.
17. 30.11.2018 –Accordingly we filed a fresh case No 12842/2018 for grant of equal MSP to all combatant ranks and also challenged the office memorandum issued on 29.12.2017 in case of the two individuals and the honorable court has issued notice to the Govt.
We will definitely win the case and the only option available with the Govt is to delay it as long as they can. We are well prepared to face all challenges and tactic adopted by Military and Civil bureaucrats to delay it. We know that they are also utilizing ESMs from own community to obstruct the case. I repeat that no other organization except Voice of Ex Servicemen Society has filed case for equal rate of MSP to all ranks in any court of the country. Some individuals have filed case in individually capacity.

Basic Fact of MSP-

Equal rate of MSP, a dirty game of Army Headquarters : Clarification regarding news published today in the news paper. As you know MSP has been granted to recognized tangible/intangible difficulties and various aspect linked to special condition of service. Six CPC has already clarified that status will not be decided by the MSP and difficulties experience in field by the Commissioned officers and below officers ranks are same.They also mentioned that MNS is not a fighting troops. The 7th CPC commission clarified that superannuation of defence personnel, particularly other ranks at a younger age, is also a factor that has been considered for MSP.
Voice of Ex Servicemen Society has been pursuing the case for equal rate of MSP to all combatant ranks since the year 2013. In the Aug 2016 we had conducted ‘pad yatra’ from Bagha Boarder (Amritsar ) to Delhi demanding equal rate of MSP to all ranks. However, to create rift between JCOs/NCO/ORs and divide the movement , the service Headquarters recommended 10 thousand MSP to JCOs only and news to this effect was also published during our pad yatra. The Min of Def has also forwarded the Recommendation of Service HQ who has supplied wrong data, to Min of Fin ignoring the interest of jawans. Now the Finance Ministry has rejected the proposal of Min of Def which has been published in today news papers.
Meanwhile , after constant pursing the case in court, finally on 30.11.2018 the honorable Delhi High Court has issued notice to Govt on our plea to grant equal rate of MSP to all combatant ranks. Dirty game of Army HQ will defeated in the court as the Army HQ has twisted the matter and misguiding the Govt besides misinterpreting the concept of MSP. Hope Govt will not loose trust and support of ESMs and demoralize serving soldier and will grant Equal MSP to all ranks.
